Ms Tong Lai Ling obtained her Bachelor of Laws (Hons) Degree from Victoria University of Wellington, New Zealand in 1993. Following her admission as a Barrister and Solicitor of the High Court of New Zealand in 1993, Ms Tong practiced in Auckland, New Zealand in the areas of conveyancing and commercial law in the law firms of Sellar Bone & Partners and Ellis Gould until her return to Malaysia in late 1998. After her call to the Peninsular Malaysian Bar in 1999, Ms Tong practiced in Raja Darryl & Loh predominantly in the areas of corporate and commercial law, and Information and Communications Technology (ICT*). She joined Kadir, Andri & Partners in September 2002 where she again worked in the areas of ICT, commercial laws and corporate finance. Ms Tong returned to Raja Darryl & Loh in June 2005 as a partner in the Intellectual Property & Technology Department.
Ms Tong practices in the areas of technology, media and communications (TMT) and data protection. She works with a wide range of clients across these areas of practice, advising on commercial and corporate issues and drafting and negotiating IT, telecommunications and e-commerce contracts (including consumer protection issues)
Ms Tong’s experience includes reviewing, structuring, drafting and negotiating commercial transactions and agreements relating to inter alia, software development, software licensing, provision of hardware, service level agreements, maintenance/support services, cloud services such as Software-as-a-Service/Infrastructure-as-a-Service, and also distribution and reseller agreements. She is familiar with procurement, collaboration and outsourcing agreements, as well as e-commerce agreements and online marketplace agreements, website/portal terms and conditions, mobile application terms and conditions and privacy policies.
In addition, Ms Tong advises on the laws relating to technology and telecoms (including the Communications
and Multimedia Act 1998 (CMA), the Digital Signatures Act 1998 and the Electronic Commerce Act 2006) and
compliance with the Personal Data Protection Act 2010 (PDPA) and has conducted numerous in-house training sessions for clients on PDPA compliance
